Club 33 lawsuit

I just saw the article. The man suing DL violated the terms of the Club 33 membership, and is suing because his membership was terminated. DL reps say it's not the first time. The part that really irritates me is the paragraph quoting his attorney: "An attorney for Cosgrove, Mark Corrinet, said Disney has provided no evidence that Cosgrove has previously violated the club’s rules. He said he doubts that the company would want to fight the lawsuit against an elderly, longtime Disney devotee." Sounds like a classic case of someone not reading a contract, suing when the contract is terminated and hoping the company would rather settle and make it go away than fight it.

Disney has done the right thing here. This man took advantage of the Club's hospitality for years and years, in addition to breaching the legal contract, and Disney finally did what they should have done years ago and cancel his membership contract.

That said, it's kind of sad, if only because their home appears to be decorated with a whole lot of Club 33 merchandise. While the husband is busy calling an attorney, the wife should call an interior decorator ASAP.

Without seeing the actual membership contract and the evidence Disney has detailing previous violations, it's really difficult to have a factual opinion on the case. What did Disney do or say after the previous violations? What, if any, type of action is spelled out in the contract? Did they or could they have imposed suspended privileges for a year or some other sanction besides revocation? Is the membership transferrable to a family member through a will upon the members death? On the surface canceling a 48 year membership from one of the original 100 seems kind of drastic. Maybe there is some VIP who is next on the list and this is how Disney gets that person in.

It comes down to the guy has repeatedly broken the rules and has been suspended before. Eventually Disney's grace runs out and they have no qualms canceling a problem member regardless of how long they've been around.

He's not an original member. He's lying. His lawyer is also lying (SHOCK! A lawyer lies?!?), or else his client has told him untrue information and the lawyer is just repeating it.

The man joined Club 33 in 1979. He's been a member for 36 years.

If there was some fabulous VIP on the list that Disney wanted to sell a Club 33 membership to, they would. It's Disney's club, they can let in whoever they want whenever they want.

Exactly. The waiting list is only a waiting list if Disney wants to keep someone waiting.
