I agree with most of what you said, but Avatar fits better in Animal Kingdom then a lot of people want to acknowledge. Both AK and the Avatar movie share a theme of environmental conservation, and AK was always supposed to have a 'fantastical' area within the park.

It could be a relatively minor tweak to the story line and narration to just remove the Twilight Zone references if they wanted to. The premise of the ride could stand alone without it.

I'm pretty confident that the Disney legal team is much more aware of what the contract allows and does not allow then anyone on this forum. If they are focussing this ride on the GotG, then they are obviously allowed to do so. If there was any question about it, they would have cleared it up...

I would hope anything that will be taking over an entire pavilion would classify as an E ticket... I'd lean more towards a thrill ride based on the subject matter, but who knows... could be good either way.

I still think GotG into RnRC would make more sense. It's such an obvious (and probably cheap) overlay of an existing ride, I'm shocked Disney isn't going that route. It wouldn't really fit on Sunset blvd, but it doesn't really fit in EPCOT either.

I was there last week and I didn't think they ruined the view. However, I think they look worse from the boats when looking at the beach for some reason. It just looked......odd. But when standing on land, it didn't bother me at all and I thought they looked nice.

If they hadn't set a hard opening date and proceeded with a soft open, followed by an official opening when the ride was ready, no one would be complaining. The ride is behaving like most rides do during their testing/soft-open period. Of course, you could say they should have been finished...
