Umm, you have a bad guide then. You can buy ANY DVC property (well, except VGF). You may have to go on a waiting list, but you can buy wherever you wish. Don't let them tell you different.

It depends. The general rule is that if the price agreed upon for a resale sale is too low Disney will step in and exercise ROFR. Outside of low price sales there have been stretches of time when Disney was very active anyway in the right of first refusal process and times when they have not been.
