My bad experience at Disneyland

Hello everyone, I wanted to share my experience at one of the Disney parks. I'm not doing this to throw shade at Disney, but I felt like I needed to get this off of my chest because the person who was really affected has recently passed away. Side note, if you don't like bad/sad stories, please click away.

So, a long time ago (around 2011-2012 before the refurbishment of the Matterhorn Bobsleds) My mother had decided that me and my cousins should go to Disneyland. So we packed up and left for a 2-hour journey( more like 2 and a half because we got lost). We finally got there and my aunt and cousins decided to split off and leave me and my mom. So we split off and headed towards all of the rides. All of the rides were amazing except for the last ride.

The Matterhorn was the last ride that we wanted to ride before we left to get some for in another land somewhere. (Side note, my mother was very handicapped so we had to be escorted into our own Bobsled before the other guest got in. We were off and their ride was going great until someone had spilled their food and drinks into the ride control box. So we ended up sitting in one spot for 10 minutes until a few cast members arrived to manually push our cart down. The 2 cast members were talking to us for a bit and even joked around saying that the drink that fried the electrical box was Pepsi and told us to buy coke. When it was all said and done we were pushed down and at the end of the ride. As soon as we were able to get out the cart, I noticed that the exit point was raised higher than the entry point. As well, the cart was not securely locked. (This is where Magic went south) My mom struggled a little trying to get out when the cart moved forward and my mom's foot slipped and got caught into the railing of the track. She started to struggle even more and I tried to call for help. She could not get her foot out through the small gapped tracks. We finally got a Cast Member help, but he made things worse. He tried to get the cart to lock but he ran over my mom's in the process. This lead my mom's food getting shattered in 3 places. More Cm's and guest exiting the ride came to get my mom out and finally did. Her foot was very swollen and her toes were snapped in very horrible areas and it looked horrible. We had to call the First Aid office to come and wheel chair her to the onsite medical office. While we waited for them to arrive, the guest tried to assist my mom as best as they can (and I still truly thank them for this from the bottom of my heart). They even gave us their numbers and said they would help if we needed witnesses. Then the First Aid team finally arrived.

As fast as they could, they wheelchaired my mom to a nearby office and took down our information down. Then they put my mom on a stretcher and gave her the highest dosage of Ibuprofen with an ice pack. At this point, I was crying and trying to assure that my mom was ok. But my she was tough as nails, she cried for a bit then just kept saying that her foot was in pain. Now, you may be asking "Where'd your Aunt and cousins go?" Well, my mom called her and they said that they left the park to go home, even though we were the only way they could get back to our house.
We waited just a little longer, then a nurse asked us if we wanted to call an ambulance or receive a free ticket to be wheelchaired back into the park even with the broken foot in a makeshift cast. So we obviously went with the ambulance.

So they called 911 and took us to the back/side gate of the park. Along the way, we asked the cm who took us there if we could get any compensation, and he said: "I'm sorry miss, but we can't o anything on our part to give you any type of compensation". Then we finally got to the gates where a few paramedics were waiting for us and took my mom to a Kaiser Permanente nearby.
So that's it, that was the story of my worst trip to Disneyland. Now I have a question for you guys. Its been so long now since the accident and my mother tried to sue Disney for medical bills, but no lawyer would take on Disney in fear. Do you think We could have or still get any type of compensation? Even just a ticket for me? Idk but I'm glad I could get this off my chest. Thank you for taking your time out just to read this. Also, Im sorry that this is really slopy writing, my phone was about to die and I wanted to finish this.

We are very sorry to hear that your mom was injured. We, however, agree, as others have said, that the statute of limitations has probably run on her claim and time has slipped through the hour glass. Hopefully you will benefit by sharing this with us and having a question gain the collective responses you may get. Best wishes.

So you are not intending to "throw shade" but you join to get something off your chest about an injury five years ago to a loved one that has since deceased.

I will give you credit for thinking about being compensated at the time though. Most people wait until after the ER visit to broach that delicate subject.

I call bunkus. Such an incident would qualify as an attraction accident. Cms wouldn't just take to first aid... the EMTs would have been involved and she would have been put on the 'bus and taken out for X-rays.

Disney is very loving when someone gets hurt because they try to gain favor and avoid lawsuits. And it's a drive by poster.

In the era of calosha... this wouldn't go down as described

This whole post seems a bit fishy to me for several reasons, but I will not cast aspersions. The only thing is...Sam should have at least given them a free dessert voucher. I mean anything more than a half-hearted apology and an eye roll.

I'd agree with you, but I was at the park when my friend suffered a similar incident at Indiana Jones. The treatment my friend received was about the same or less than the OP's: A complimentary wheelchair rental and a trip to first aid. My friend was a really good sport about it and never thought about suing, but there were no EMTs, buses or x-rays even though my friend was in pretty remarkable pain and the foot looked gnarly.

FWIW.

Your friend went INTO the ride path and was ran over by a ride vehicle? Or, your friend hurt their foot?

What is with people and compensation these days?!
People look for free handouts all the time. Just because I get my foot run over by a stroller while walking around Disneyland doesn't mean Disney has to give me money for hurting myself. It probably didn't help matters that the OP asked for some form of compensation to a CM immediately. They would instantly feel like they are being scammed. Of course a front line CM can't authorize any form of compensation. That is what legal is for. The nurse did everything she could and had an ambulance pick up the guest. We don't know what happen after that.
