Exactly, you are encouraged to participate, kids are invited to dance. The idea of WDW is that parents videotape their kids having fun meeting characters, dancing at dance parties, or flying at Dumbo. It's whole point of it all.Oh please they encourage you to get out and dance so it's not the parents fault this happened.
The test when I was a kid was if you could bend your arms, move your legs, wiggle your fingers and weren't bleeding from the ears, you were good to go.Ouch! That looked painful. I can only imagine if I was the kid my mom would have said, "Are you alright?" and I likely would have said yes if I could move all my limbs...that was the deciding factor for being alright. If I fell out of a tree but could wiggle my fingers and toes I was alright and just kept playing.
Whenever something like this happens I always wonder if it happened elsewhere would people expect a payday? If this was a kids birthday party and Dad was flailing around and knocked over a kid would people be screaming about lawsuits? I guess it really depends on the people but my family was more of a get up, dust yourself off, take a few minutes if you need them then get back out there and have a good time.
I would hope Disney would offer a small good will gesture. If she did have medical bills they should pay them but they should not have to pay more money than the average Joe simply because they have it.
The small child moved into the area by the CM, the CM did not move towards the child.

In reality it's nobody's fault. The CM could not have anticipated the kids would move in next to him like that, the parents didn't see it coming and the kid is just a kid. That's why the word accident exists. As a good will gesture Disney should have done something for the kid. It sounded like from the story the kid was fine.
And it's a possibility that Disney has already done something for the kid...the parents just might want more.

But if Disney did apologize, which they said the kid did (I think) and covered any medical bills and these people are still involving the news and Channel Six, then they may be looking for easy money.
If they really refused to discuss it with the family, then I couldn't blame the family for getting a lawyer to get a court to demand an answer.

In any event, it seems no lasting damage was done and the kid is okay, so I'll leave it to Disney and the family to fight out.
Not trying to make light of a kid getting hurt, but if she had a "magic band" on maybe the secret NextGen police that will be tracking us all in the parks would have been able to stop this from happening. If not at least the dancing cast member would have known the girls first name without having to ask. And you guys say nothing good will come from the magic bands.

Of all the safety precautions that the Disney parks take - like putting a fence around Alice in Wonderland out in Disneyland (I realized they were forced), the height restrictions for some rides, no riding in front of the monorail, closing attractions that are built over sinkholes (joking about that one obviously) - the "dance parties" seem to be counter intuitive. Way too many ways for someone to get hurt.
It seems like a company that is so publicly watched, both by the media and by thousands of parents with iPhone cameras, that they wouldn't want to have this potential photo-op out there. To get hurt on the Great Movie Ride, for example, you have to try hard...really hard, and there are rules about standing up during the ride, hands inside the vehicle, etc. But then you can walk outside and into a dance party where arms and legs are flailing and CMs are jumping around throwing elbows that any pro hockey team would be proud of.
***rolls eyes***God forbid Disney apologize for knocking a kid down...or offer to pay any medical bills.
