Boy that new member who posted this nonsense and then ghosted the thread like the katybug sure stirred up all the regulars. I guess that was her goal, and it succeeded. Also, I woke up this morning with my right eye totally blood red and I currently look like a zombie. I was diagnosed with a burst blood vessel that will take two weeks to get back to normal. Can I sue my partner of 20 years because it happened in his bed?
I would start there. 😂 I had the same thing about 5 years ago. Your blood pressure may be high. I have been
on 25mg of hydrochlorothyazide ever since. Don't wear an eye patch it will freak people out more. 😂😂😂

I would pursue a claim if:

The bartender threw a glass of Guinness at me for no reason and I fell off the stool.

A piece of the ceiling fell down on me and made me fall off the stool.

The bartender put a “mickey” in my drink and made me pass out and fall off the stool.

Someone spilled something on the floor by my stool that didn’t get cleaned up right away and when I stepped down, I fell off the stool.

One of the dancers kicked me in the face and I fell off the stool.

I would not pursue a claim if I just accidentally fall off the stool. Call me crazy for thinking about taking personal responsibility.
Okay, "You are Crazy"! (You told me to.) I do however agree with you. It does seem though that clumsy and awkward
can be insured and if you push it enough you will probably get paid something. People with less legitimate claims have.

I'm not sure why you find it so hard to understand.

What part of someone falling off a chair is anyone else's fault other than the person falling off?
I fully understand, This is coming from someone who broke their neck ( C2/C3 ) in my own home in Central Florida. I sued my own home owners insurance and won. You know who advised me to sue them? They did, sometimes it is how it works.

Yes but it’s also the responsibility of the restaurant to exercise reasonable care to see the floor is kept free from substances that could cause a fall. Floors have been known to be uneven, improperly waxed, etc.

The OP wasn’t stating a complete set of facts because she wasn’t asking for legal advice; she just wanted to know how to report the incident and then later how to get contact information requested by her own health insurer. If you read through the thread, there’s no indication she’s trying to sue the restaurant. Your post was unnecessarily simplistic and insulting.

Actually no it isn't. Under Florida statues, a business’s customers are considered to be “invitees”, entitled to the highest duty of care from the business or property owner. These duties include undertaking reasonable efforts to keep their premises clear of dangerous or defective conditions that might injure invitees. Under Florida laws, to win a slip and fall case, you must prove the following:
  1. You slipped on a substance
  2. The fall occurred on someone else’s property
  3. The substance created a dangerous condition
  4. The property owner had actual or constructive knowledge of the dangerous condition
  5. They should have fixed it
  6. They didn’t fix it.
Florida is a comparative fault state, if you bear some share of fault for the slip and fall accident and your injuries, you may also be required under Florida law to be responsible for some portion of the losses you incur due to your injuries. In Florida’s comparative fault system, your total compensation in a slip and fall claim will be reduced in proportion to the percentage of fault you have for the accident and your injuries. Florida specifically uses a “pure” comparative fault system, meaning there is no restriction on your right to file a claim based on your percentage of fault. Even if you were 90 percent responsible for the slip and fall accident, you can still pursue a claim to recover 10 percent of your losses.

Insurance companies are also responsible for defending against any liability claims. Often an payment offer is made to make the claim go away and in the long run cost them less than it would cost to defend. (25+ years of Commercial Insurance experience.) Sometimes it really doesn't matter what actually happened.

I was thinking the exact same thing. Didn't take too many pages before this thread started going off the rails either.

I have to admit I visibly laughed when @LittleBuford mentioned someone did a laugh emoji at the OP (see post #109). Not because it's funny (no it's pretty screwed up), but JUST because it actually did happen. Seriously, how ducked up can this thread get?
