I got into a altercation @ F & G festival! Got a reply "NEW"

My wife and I took a adults only trip and had a great week!! On the way out of Epcot we had a quick bite at Le Cellier and were about to head out for the airport with a quick stop back at WL valet for a special item they were holding. Here's where things went WAY down hill.
We were looking at various vendor booths on the way out and taking pictures as we went along. A person came up to me as I was taking a picture of some different plant stands because we thought they were unique. He blurts out "what are you doing?" I looked at him and was kind of stunned. He then tells me I CAN"T take any pictures of the plant stands because they have copyrights and patents on them. I laughed then and said whatever, not a big deal. But it was the way he approached me and told me not to take pictures. If he had asked me in a kind tone, I would have gladly went on my way. The more I thought of this guy getting on me I thought about how wrong it was. If he had something so special and secret, why bring to a public place where pictures are going to be taken. I went to guest relations and talked to a manager. I asked if it was ok to take pictures of vendors and their products. She said by all means yes I could. I told her of the rude person and his way of telling me not to take pictures. I asked her to follow me or get someone else who could watch me take pictures. She said not at that time but gave a number to call when we returned home.
Out I went to take my picture and get his exact location and name. As soon as I took a picture, his partner tells the jacka#$ that "he's back!!". He comes rushing over and gets in my face and said I told you not to take pictures!! I said you have no posting of copyright or patent issues. He blasts back that WDW wouldn't let him post anything. He's getting more ****ed by the second and starts foaming around his mouth!! He knew I had him and I told him so. As I said that I had a pen in my hand and waved it in front of him. He's says "IF YOU WAVE THAT PEN IN FRONT OF MY FACE ONE MORE TIME!" Now I laughed out loud and said right back to him " and what do you thing your going to do to ME!!" His wife yells to let it go and he storms to the back of his booth. I got my point across and left the park. I felt better at least having my say.
Now I'm running late for the airport and stop by to get a candy sculpture made by Miyuki @ the worldshowcase. It was left in the valet refrigerator with a p/u luggage tag. They couldn't find it at all. THey said someone must have stole it or gave it to someone else by acciident!! Already aliitle stressed from the flower and garden fellow, I just laughed... They did send another one a couple days later. Which I was grateful for. And we made our flight with about 15 minutes to spare. We were just disappointed by the way a great week ended. WDW and the flower and garden organizers should keep an eye on guest interaction with vendors. I thought he was going to swing at me at his booth!! Oh well, we kinda of laugh now but I was ****ed on the plane ride home though. Thanks for letting me post my long story....

Wow that's awful! I'm sorry your vacation ended so poorly! At least you got to get your pictures! If only you had a videocamera instead of still pics...... It would have been very hard for Disney not to do something about it if you had footage of this guy acting like that!

let Disney know... while they do read these message boards, without an actual complaint, there's very little they can do..

MKT, did this person have a legal right to tell me not to take pictures? I think finally getting this on a board will inspire me to have this looked into. I really am a "go with the flow" kind of guy. But don't"TELL" me what to do!! Asking politely goes a long way.

while he may own the image copyright to the items in the photograph, I'm almost certain that Disney makes them sign some sort of contract allowing for photography.

Either way, complain. Disney will take the word of a guest 10 times over what the other party (CM, Vendor, etc) has to say... I should know... :lol:

PLEASE tell me where about (what area) this vendor may be located and a description of the table/product display - and the particular person who gave you such a poor attitude. I will be visiting the F&G Festival in the immediate future and want to make sure this problem is not continuing with other guests - including me! And yes, I will probably have camera in-hand. :D

Having what MKT mysteriously referred to as an "image copyright" (aka Visual Art Work copyright) does not in itself bar photography (or videotaping, or hand illustration, etc.) The issue lies more along the lines of too-similar or identical reproduction - which can often be more of a patent issue.

Just for fun, here's a little bit of information on the topic. A “useful article” is an object having an intrinsic utilitar¡an function that is not merely to portray the appearance of the article or to convey information. Examples are clothing, furniture, machinery, dinnerware, and lighting fixtures. An article that is normally part of a useful article may itself be a useful article, for example, an ornamental wheel cover on a vehicle.

Copyright does not protect the mechanical or utilitarian aspects of such works of craftsmanship. It may, however, protect any pictorial, graphic, or sculptural authorship that can be identified separately from the utilitarian aspects of an object. Thus, a useful article may have both copyrightable and uncopyrightable features. For example, a carving on the back of a chair or a floral relief design on silver flatware could be protected by copyright, but the design of the chair or flatware itself could not.

Some designs of useful articles may qualify for protection under the federal patent law.

It is lousy to end a vacation that way. I am planning an adult trip myself for next year hopefully. I agree with the others that you should complain about this vendor. Since his reaction was immediately explosive; it indicates a probable underlying problem with him. That's why one shouldn't escalate with these kind of people. Hope all goes well with you next trip around.

This guy has NO business being a vendor at Disney. I absolutely can't imagine being treated this way at "The Happiest Place on Earth" (I know, I know that's actually Disneyland). Please, please report this person. He was actually threatening you!!

BADGER: You handled it better than I probably would have. Good for you.

MKT: I now realize the jest of why you are no longer employed by WDW, but I'm glad you haven't lost your interest in Disney. That would have been a waste.

Westie, I normally don't sweat the "small stuff". But when someone verbally and almost physically abuses you over some "small stuff" you sometimes have to stick up for your rights. I have let a lot of dining issues, rude people in parks, rude people during parades and fireworks, go when I should've said something. I think I have a legit complaint here. Sorry if you disagree.:wave:

Timekeeper, that man looks pretty angry. It looks like he's yelling at someone for photography right there in that picture :lol: .
