    It in NJ you don’t, unless there is an imminent (there is that word again) threat to life. To be fair, I’m sure all burglars look threatening in the dark at 330am. I personally, even in a state that allowed it, would not use lethal force unless I felt that imminent threat.

    I would say I would not recommend using potential lethal force against someone that is not posing an imminent (key word) life threat. It depends on many different factors. If somebody broke into my house, saw me and said they were going to punch me until I passed out, I would not today see that...

    Again, you are wrong. If you believe you were not able to retreat is used as the measuring stick...not an observer to the event, unless they are an expert on your current state of mind or physical condition. And how do you explain the 3rd person aspect?

    Do you believe your life is in imminent danger, or believe asking the burglar to leave would place you in imminent danger?

    Correct. You must believe you or a third person face an imminent life threat. There is no blanket duty to retreat, as was asserted.

    No. If you believe you or a third persons life is in imminent danger you have the right to use force necessary to protect those lives, regardless of the location. Please point me to the portion of the law that supports your assertion.
