Actually this is nothing about copyrights and everything about STEALING.
Yes it does, because it the copyright that protect Disney. WIthout the copyright and/or trademarks, anyone is free to use the characters.

These courts broadened the scope of copyright protection by adopting the total "look and feel" approach from trademark and unfair competition doctrines and adapted it to copyright infringement analysis. In addition, the popularity of the character, at least implicitly, began to be factored into the substantial similarity copyright infringement analysis with the result that the "feel" of the character reduced the level of similarity needed to prove copyright infringement. In Walt Disney Productions v. Air Pirates the court appeared to commingle copyright and trademark law infringement criteria by stating that the Disney characters used by the defendants had "achieved a high degree of 'recognition' and 'identification'" and that these elements helped make the characters protectable under copyright law. In addition, the court seemed to rely upon subjective criteria, that was more similar to the secondary meaning analysis frequently required in trademark infringement cases, rather than a more exacting review of the similarity of the characters.<SUP>8</SUP> [/FONT]

A copyright only legally protects you in the country of origin. These people are stealing the intellectual property of Disney.

This is going to have to go to the World Trade Organization for a cease and desist order.

International law gets hairy and a good lawyer can sort it out, which I'm sure Disney has. in general, most countries offer protection to foreign works under certain conditions that have been greatly simplified by international copyright treaties and conventions.

Protection may be available in other countries by virtue of a bilateral agreement between the United States and other countries or under specific provision of a country’s national laws. (See Circular 38a, International Copyright Relations of the United States.)

My point being, there is protection out there from people stealing and/or using other people work without authorization, even Internationally. US Copyright laws have been extended to protect characters otherwise Disney, Bugs and many other would be abused like Speck stated in the OP.

I don't think you went political.....it was a good discussion and yes you are correct how well can it be enforced.....:)

the problem is .. china a paradise for bootleggers, pirates and copyright thefts .. so what you gonna do about it ?

legal threads ? they'll laugh about it ..
embargos ? we want their money(US,Europe) .. not the other way around ..

so not that many options .. right ?

Disney has been talking about building a theme park near Shanghai, why don't they just buy this one? It already has a castle and SSE (which is a movie theater..I would assume like IMAX). J/K

This is not the first time that this has happened. There is a now-defunct park in Japan called Nara Dreamland which had an exact duplicate of the railway station from Disneyland at its entrance (so exact it was scary), a main street, and a castle. Even the proportions of the street and castle were correct (though the buildings were different). Japanese investors tried to get Disney interested in Japan as an eventual park destination in the 60s, but back then Disney Co was awash in WDW in Florida plans so they declined. These investors went to DL and copied (very accurately) as much as they thought they could get away with.

Nara Dreamland closed in August 2006..I am assuming that TDL put it out of business. By the time it closed it was basically a ghosttown and very run down (except, amazingly, for the Disney copy part..that seemdd to have been kept up better than the rest of the park.)
