Other than the vehicle running a red light, these are some shady lawsuits. And even that one is just that - an accident. People that sue because there's the slightest chance of personal gain disgust me. Every day that you get out of bed, there's risk involved. Deal with it.

Fun fact: there were a couple of hot coffee cases prior to the $2.9M in damages famous case. In those previous cases, the awards were significantly less and no reform. One was the customers fault ($27k in damages), the other was the employee's fault ($230k in damages). In the $2.9M case, the lawyer whipped the jury up to an emotional fury and then casually dropped the info that MCD made $1.35M a day in coffee revenue worldwide. Then the question became, how many days in coffee should MCD be punished for. Jury chose 2 days + 160k in compensatory damages for the total award. MCD appealed and her award was reduced to an undisclosed amount. Of note: she spilled in on herself and originally asked MCD to pay her medical bills of $20k and they refused which caused the lawsuit.

So much like our Permitting Thread, I'm going to take a look at the cases filed against Disney in Orange County District Court. (Osceola isn't online and they would transfer it to Orange anyways)

Filed 1/14/16. Premise Liability. Plaintiff's son fell off an inner tube on a waterslide at Typhoon Lagoon. Another guest went down the slide and struck defendant's son.
Wants unspecified damages.


2016-CA-000409-O ROSALES, OMAR et al. vs. WALT DISNEY PARKS AND RESORTS US INC

Filed 1/16/16. Plaintiffs were on the Peoplemover in October 2014 when the ride malfunctioned, causing the plaintiff's ride vehicle to strike a vehicle in front of them as well as their behicle was struck from behind.
Wants damages in excess of $15,000.

Filed 1/25/16. Premise Liability. Plaintiff slipped and fell at the toppings bar of Pecos Bill's.
Wants $15,000.


2016-CA-000651-O AMBUHL, KENNETH et al.vs.BAY LAKE TOWER AT DISNEYS CONTEMPORARY RESORT CONDOMINIUM ASSOCIATION INC et al.

Filed 1/25. Premise Liability. Plaintiff was attempting to go through the gate in a wheelchair to enter BLT's pool area when the gate abruptly slammed shut, injuring plaintiff's toes.
Wants unspecified damages.

Looks like that is the maximum allowed in county court.

34.01 Jurisdiction of county court.—
(1) County courts shall have original jurisdiction:
(a) In all misdemeanor cases not cognizable by the circuit courts;
(b) Of all violations of municipal and county ordinances;
(c) Of all actions at law in which the matter in controversy does not exceed the sum of $15,000, exclusive of interest, costs, and attorney’s fees, except those within the exclusive jurisdiction of the circuit courts; and
(d) Of disputes occurring in the homeowners’ associations as described in s. 720.311(2)(a), which shall be concurrent with jurisdiction of the circuit courts.

Edit - After further review, this might be incorrect. I think the above is related to criminal law and not civil law. Maybe one of lawyers of the forum can comment.

Seems to be, I'm not familiar with that aspect of the law but all the cases seem to be asking for $15k or $15k and above.

2016-CA-000815-O MOBLEY, HELENA vs. WALT DISNEY PARKS AND RESORTS US

Filed 1/29. Employment Discrimination. Plaintiff, an admin for a Disney Security Executive, applied for a Executive Assistant and was told by her boss she was a shoe in. Didn't get it. Complained, alleged discrimination because she is married to an African-American. Was told there wasn't a place for her in security division anymore after complaining. Plaintiff alleges retaliation for the complaint. Plaintiff is now working as an admin assistant in custodial.

Just about every time I visit WDW I get a blister on my toe because Disney has too much walking on concrete. This resulting injury causes pain and suffering, medical expenses and loss of enjoyment of life while at WDW. I'm suing.
